In April 2023, Governor Inslee signed the nation-leading My Health, My Data Act, which provides widespread privacy protections around collecting, sharing, and selling consumer health data and geofencing data. These protections are fundamental to protecting patients and providers, as anti-choice states continue to use tech data to target abortion care.

In a post-Dobbs era, the Reproductive Freedom Alliance is a critical effort by states to protect abortion access across the country. States can do more to protect reproductive health when they work in solidarity. However long it takes, our states will work to ensure the right to choose is once again protected at the federal level.

    Amicus Brief Challenging Idaho’s “Abortion Trafficking Law”

    Amicus Brief in Alliance for Hippocratic Medicine v. Food and Drug Administration

    Governor Inslee and 21 other governors filed an amicus brief with the U.S. Supreme Court in support of abortion rights in Food and Drug Administration, et al., v. Alliance for Hippocratic Medicine. In this brief, the Reproductive Freedom Alliance governors argued that if the Court reverses FDA approval of Mifepristone and limits access to the vital medicine, it could undermine Governors’ ability to provide adequate healthcare services and would have far-reaching implications beyond reproductive healthcare.

    My Health, My Data Act

    This nation-leading data protection law requires companies to get explicit consent from a consumer to collect, share or sell the consumer’s health data. Additionally, companies are prohibited from geofencing particular locations to collect and sell data. Under this law, consumers can sue organizations that don’t get their explicit consent to use their data, and the attorney general can also take legal action on behalf of consumers.

    This public law protects health providers from being disciplined or having their licenses revoked for providing legal reproductive health services or gender-affirming care in Washington. Under this law, any provider punished under another state’s laws will not have their license denied in Washington as long as the service was lawfully provided in the state.

    Secured A Three-Year Supply of Mifepristone

    Governor Jay Inslee announced that, in anticipation of an anti-choice court decision, Washington state purchased a three-year supply of mifepristone, an abortion medication used safely for more than two decades. Governor Inslee directed the state Department of Corrections, using its existing pharmacy license, to purchase the medication in April 2023, and subsequently signed legislation to authorize the department to distribute the medication to health providers.
