Washington State is a leader in efforts to protect reproductive freedom. Governor Ferguson has championed important policy to protect and expand reproductive rights. Immediately after taking office, Governor Ferguson issued an Executive Order to affirm access to the full spectrum of reproductive healthcare in Washington State, including pregnancy care, contraception, miscarriage management, and abortion. Governor Ferguson Issued Executive Order 25-01

The Executive Order directs the Washington State Department of Health to convene a roundtable of medical providers, reproductive health experts and policy makers to recommend strategies for protecting reproductive freedom. Additionally, the Executive Order affirms Washington State’s commitment to protecting and advancing access to abortion care that meets each patient’s needs.
Washington continues to protect access to lifesaving and health-preserving care, including abortions. We know that anti-choice extremists will not stop attacking reproductive health care, even when it costs women’s lives. We will fight even harder to protect it.

    Challenging Mifepristone Restrictions

    In August 2025, Washington joined a multi-state coalition in filing a petition to the U.S. Food and Drug Administration to remove medically unnecessary, burdensome restrictions on mifepristone, a safe and effective abortion medication. The petition states that “given mifepristone’s well-established safety record in the United States over the last 25 years, its critical importance for abortion care and miscarriage management in Petitioner States, and the undue burdens the Mifepristone REMS Program places on patient access and the health care delivery system, the Mifepristone REMS Program should be removed in its entirety, or alternatively, FDA should exercise its discretion not to enforce the Mifepristone REMS Program (or elements thereof) in Petitioner States.”

    Lawsuit Protecting Planned Parenthood Funding

    Washington joined 22 other states and the District of Columbia in filing a lawsuit against the Trump administration, challenging the 2025 budget reconciliation provision that prohibits Planned Parenthood health centers and a small number of other reproductive health care providers from receiving Medicaid reimbursements for one year if they meet certain qualifications. In the lawsuit, the States have argued that that the defunding provision violates a number of constitutional requirements, including the Spending Clause of the Constitution, will have a harmful impact on their states’ residents, and violates Planned Parenthood’s First Amendment rights. This lawsuit aims to protect Medicaid patients’ access to reproductive health care by keeping long-standing, essential Medicaid health care providers in the program.

    Emergency Funding for Planned Parenthood Health Centers

    In July 2025, Governor Bob Ferguson announced that Washington state will provide $11 million  in funding for Planned Parenthood in the state. The move comes after the passage of H.R. 1, a federal law that prohibits Planned Parenthood providers from receiving Medicaid funding. Planned Parenthood operates 30 health care centers across the State of Washington, which serve over 100,000 patients each year.

    Governor Ferguson affirmed that Washington State will continue to implement a rule directing the Department of Health to provide emergency services, including abortion, to pregnant patients with emergency medical conditions. The directive, which was issued by former Governor Jay Inslee, prohibits hospitals from withholding care because a person is pregnant.

    Senate Bill 5632

    In May 2025, Governor Ferguson signed S.B. 5632 into law, which updates the state’s shield law to define “assistance” as that term relates to the provision or receipt of protected health care services that are legal in Washington. In doing so, the bill expands shield law protections that prohibits agents of state or local agencies, commissions, boards, and departments from cooperating with or providing information to other entities for the purpose of advancing out-of-state anti-abortion prosecutions. S.B. 5632 also requires Washington businesses that provide electronic communication services to notify the Attorney General’s Office if the entity receives legal process related to the provision or receipt of protected health care services when the required attestation is missing or incomplete.

    In May 2025, Governor Ferguson signed the Fiscal Biennium 2025 – 2027 Appropriations Bill into law, which provides $3.5 million per year for programs to maintain access to abortion care in Washington, including but not limited to: provider support, workforce retention and recruitment initiatives, and clinic security investments.

    In April 2025, Governor Ferugson signed S.B. 5498 into law, which requires most insurers to cover a 12-month supply of contraceptives obtained at one time, rather than applying only to a 12-month refill. This law goes into effect on January 1, 2026.
