    Investment to Planned Parenthood and Family Planning Clinics

    On October 23, 2025, Governor Kathy Hochul announced that the state of New York will fully cover one year of Medicaid funds for Planned Parenthood in the state (over $35 million).The move comes after the passage of H.R. 1, a federal law that prohibits Planned Parenthood providers from receiving Medicaid funding. Over 200,000 patients, including 100,000 Medicaid patients, receive health care across 47 Planned Parenthood health centers in New York each year.

    Lawsuit Protecting Planned Parenthood Funding

    New York joined 22 other states and the District of Columbia in filing a lawsuit against the Trump administration, challenging the 2025 budget reconciliation provision that prohibits Planned Parenthood health centers and a small number of other reproductive health care providers from receiving Medicaid reimbursements for one year if they meet certain qualifications. In the lawsuit, the States have argued that that the defunding provision violates a number of constitutional requirements, including the Spending Clause of the Constitution, will have a harmful impact on their states’ residents, and violates Planned Parenthood’s First Amendment rights.  This lawsuit aims to protect Medicaid patients’ access to reproductive health care by keeping long-standing, essential Medicaid health care providers in the program.

    FY 2026 Investments

    In May 2025, Governor Hochul signed the Fiscal Year 2026 Enacted Budget. The budget includes an historic $34.2 billion investment in Medicaid to maintain coverage and services in the state and invest in programs aimed at expanding access. Moreover, the budget codifies federal Emergency Medical Treatment & Labor Act (EMTALA) protections into state law and provides funding for providers to help cover the cost of abortion services, abortion training programs, and modernization of reproductive health care facilities and help protect providers from violence and harassment.

    Protecting Providers from Out-Of-State Attacks

    Under the state’s shield law, Governor Hochul rejected Louisiana’s extradition request for Dr. Margaret Carpenter, a New York provider who has been criminally indicted in Louisiana and sued civilly in Texas for providing abortion care to a patient in Louisiana. Governor Hochul declared that “We immediately, in our state capitol, set to create a shield law to protect our doctors for just a case like this. I signed it, I will defend that law, and I will in no way in hell ever extradite a doctor who was simply living up to her oath to take care of patients and to give sometimes life saving medication to someone who desperately needs it.”

    Senate Bill 36A

    In February 2025, Governor Hochul signed S.B. 36A into law. S.B. 36A allows health care providers to shield their identities on prescriptions for medication abortion and instead use the names of their medical practices. The law took effect immediately after it was signed. In signing the bill, Governor Hochul stated that “I’m taking action to strengthen protections for health care professionals and their patients, ensuring New York is a safe haven for anyone providing or receiving reproductive care.” After New York enacted S.B 36A, numerous states took action to pass similar bills.

    Governor Hochul and 21 other governors filed an amicus brief with the U.S. Supreme Court in support of abortion rights in Food and Drug Administration, et al., v. Alliance for Hippocratic Medicine. In this brief, the Reproductive Freedom Alliance governors argued that if the Court reverses FDA approval of Mifepristone and limits access to the vital medicine, it could undermine Governors’ ability to provide adequate healthcare services and would have far-reaching implications beyond reproductive healthcare.

    2022 Six-Bill Legislative Package to Protect Abortion and Reproductive Rights for All

    Governor Hochul signed into law a package of six bills to immediately protect the rights of patients and empower reproductive healthcare providers in anticipation of a final decision by the Supreme Court on abortion access. The laws take specific actions to address a variety of legal concerns, including the establishment of a cause of action for unlawful interference with protected rights and the inclusion of abortion providers and patients in the Address Confidentiality Program. The laws also prohibit misconduct charges against healthcare practitioners for providing reproductive services to patients who reside in states where such services are illegal and disallow medical malpractice insurance companies from taking adverse action against an abortion provider who provides legal care.

    In 2022, Governor Hochul issued a proclamation to declare an extraordinary session to pass the Equality Amendment, which is the first step to enshrining abortion rights into the New York State Constitution.     Equal Rights Amendment

    Passed by New York voters in 2024, Governor Hochul took official action to enshrine the expanded Equal Rights Amendment (ERA) in the New York Constitution. The expanded ERA, which reflects and builds on the state’s 2023 ERA championed by Governor Hochul, prohibits discrimination based on race, color, ethnicity, national origin, age, disability, creed, religion, and sex, which includes sexual orientation, gender identity, gender expression, pregnancy, and pregnancy outcomes. The ERA explicitly includes protections for “reproductive healthcare and autonomy” and “pregnancy, pregnancy outcomes,” constitutionally protecting reproductive freedoms.
