    In August 2025, New Mexico joined a multi-state coalition in filing a petition to the U.S. Food and Drug Administration to remove medically unnecessary, burdensome restrictions on mifepristone, a safe and effective abortion medication. The petition states that “given mifepristone’s well-established safety record in the United States over the last 25 years, its critical importance for abortion care and miscarriage management in Petitioner States, and the undue burdens the Mifepristone REMS Program places on patient access and the health care delivery system, the Mifepristone REMS Program should be removed in its entirety, or alternatively, FDA should exercise its discretion not to enforce the Mifepristone REMS Program (or elements thereof) in Petitioner States.”

    Lawsuit Protecting Planned Parenthood Funding

    New Mexico joined 22 other states and the District of Columbia in filing a lawsuit against the Trump administration, challenging the budget reconciliation provision that bars Planned Parenthood, its member health centers, and other reproductive health care providers that received over $800,000 in Medicaid funding from receiving Medicaid reimbursements and payments. In the lawsuit, the coalition argues that the provision in question is unconstitutionally vague (in violation of the spending clause) and violates the First Amendment by targeting Planned Parenthood. This lawsuit aims to protect Medicaid patients’ access to reproductive health care.

    In January 2025, Governor Lujan Grisham issued a statement affirming that “no city can restrict the fundamental rights of New Mexicans [including abortion rights] or override state law.” Applauding the New Mexico Supreme Court’s unanimous ruling to strike down abortion restriction in certain cities and counties, Governor Lujan Grisham stated that “this ruling ensures that New Mexico will remain a safe haven for health care access and individual freedom. Let me be crystal clear: as long as I’m governor, New Mexico will fight any attempt to limit reproductive health care access, whether those challenges come from local ordinances, other states, or the federal government. Health care decisions are personal, and they’ll stay that way in New Mexico.”

    New Reproductive Health Clinic in Doña Ana County

    In September 2024, Governor Lujan Grisham joined state and local leaders to establish a new reproductive health clinic in Doña Ana County. This clinic, the Center for Reproductive Health, is funded, in part, by $10 million in capital investment secured by Governor Lujan Grisham in 2022. The Center for Reproductive Health will increase access to critical reproductive health care services, including abortion care.

    The Lujan Grisham-Morales Administration streamlined the billing procedure for pregnancy terminations, worked with the Managed Care Organizations (MCOs) to enforce state requirements to increase access to contraception, expanded access to contraception at school-based health clinics, implemented a standing order for Opill, the first over-the-counter birth control pill. New Mexico Human Services Department has promoted Medicaid availability of Opill and emergency contraception through a press release which received widespread media coverage across New Mexico, multiple social media posts, and outreach coordination with the New Mexico Department of Health (NMHealth).

    The New Mexico Human Services Department increased provider rates as follows:

    1) Effective Jan. 1, 2020, increased rates for Long-Acting Reversible Contraception (LARC) by 100% to 152%;

    2) Effective July 1, 2023, raised payment rates for maternal and child health from approximately 90% to a minimum of 120% of the Medicare fee schedule.

    3) Effective January 1, 2025, payment rates for maternal and child health and primary care will increase from 120% to a minimum of 150% of the Medicare fee schedule.

    Governor Lujan Grisham and 21 other governors filed an amicus brief with the U.S. Supreme Court in support of abortion rights in Food and Drug Administration, et al., v. Alliance for Hippocratic Medicine. In this brief, the Reproductive Freedom Alliance governors argued that if the Court reverses FDA approval of Mifepristone and limits access to the vital medicine, it could undermine Governors’ ability to provide adequate healthcare services and would have far-reaching implications beyond reproductive healthcare.

    Enacted in 2023, this law provides legal protection from civil or criminal liability for clinicians providing reproductive and gender-affirming health care. The bill also prohibits the release of information related to a provider’s provision of protected health care activity to an interstate board, except when the individual or entity being investigated gives written consent to release information or when alleged activity would have resulted in liability in New Mexico.

It prohibits discrimination, punishment, or prosecution of a person based on the individual’s use of reproductive health care or gender-affirming care services. Lastly, it establishes enforcement and penalties in district court for the violation of this law.
