    Guam Adopts Emergency Care Protections

    In August 2025, Public Law 38-38, formerly Bill 24-38 went into effect, codifying emergency care protections at the state level. More specifically, the law requires emergency rooms to provide information on emergency contraception and sexually transmitted diseases to survivors of sexual assault. Additionally, the law states that upon request, providers must provide emergency contraception for survivors.

    Moylan v. Guerrero

    In 1990, Guam enacted a total abortion ban with criminal penalties for patients, providers, and even those who spoke about abortion. The ban was challenged and permanently enjoined at the time and, in the intervening years, Guam enacted other abortion regulations and restrictions. After the US Supreme Court decision in Dobbs v. Jackson, Guam’s Attorney General tried to get the original federal court to reinstate the total abortion ban, but Governor Leon Guerrero fought back, going to the Guam Supreme Court to argue that Guam had implicitly repealed that total ban by enacting the later laws. Governor Leon Guerrero won – the Guam Supreme Court held that the laws enacted in the intervening years had overridden the 1990 ban. While the Attorney General tried to bring the case up to the US Supreme Court, SCOTUS denied the appeal and ultimately the 9th Circuit dismissed the case, finding that the Guam Supreme Court had resolved the issue, preserving reproductive freedom in Guam.

    Governor Guerrero and 21 other governors filed an amicus brief with the U.S. Supreme Court in support of abortion rights in Food and Drug Administration, et al. v. Alliance for Hippocratic Medicine. In this brief, the Reproductive Freedom Alliance governors argued that if the Court reverses FDA approval of Mifepristone and limits access to the vital medicine, it could undermine Governors’ ability to provide adequate healthcare services and would have far-reaching implications beyond reproductive healthcare.
