Governor Matt Meyer of Delaware has made reproductive health and rights a cornerstone of his administration. Since taking office in January 2025, he has expanded access to maternal healthcare and championed a constitutional amendment to guarantee reproductive freedom, defined as the “right to make decisions about all matters relating to pregnancy, childbirth, prenatal and postnatal care, contraception, sterilization, abortion, miscarriage and infertility.” Under Meyer’s leadership, Delaware continues to solidify its status as a national leader in protecting reproductive rights and ensuring equitable access to care.

    Governor Meyer Signs Reproductive Health-Related Bills Strengthening Protections for Overlooked Populations

    On July 21, 2025, Delaware Governor Matt Meyers signed a bill that amends the state’s shield law to protect all health care services. This bill expands the types of legal orders that the state cannot comply with. These legal orders include arrest warrants and all other legal processes for obtaining testimony or information for investigations pertaining to legally provided health care. He additionally signed a bill that creates policies and procedures within the Department of Corrections for lactating incarcerated people.

    Lawsuit Protecting Planned Parenthood Funding

    Delaware joined 22 other states and the District of Columbia in filing a lawsuit against the Trump administration, challenging the 2025 budget reconciliation provision that prohibits Planned Parenthood health centers and a small number of other reproductive health care providers from receiving Medicaid reimbursements for one year if they meet certain qualifications. In the lawsuit, the States have argued that that the defunding provision violates a number of constitutional requirements, including the Spending Clause of the Constitution, will have a harmful impact on their states’ residents, and violates Planned Parenthood’s First Amendment rights.  This lawsuit aims to protect Medicaid patients’ access to reproductive health care by keeping long-standing, essential Medicaid health care providers in the program.

    In July 2025, Delaware joined a multistate coalition in filing a lawsuit challenging the U.S. Department of Health and Human Services’ (HHS) decision to provide unchecked access to individual personal health data to the Immigration and Customs Enforcement (ICE) and the Department of Homeland Security (DHS).

    In July 2025, Governor Meyer signed House Bill 3 into law. This law creates a breastfeeding and lactation program for women in state Department of Correction custody, allowing women to collect and send breast milk to their infant or toddler through an approved person.

    In July 2025, Governor Meyer signed House Bill 205 into law, which strengthens the state’s reproductive health shield law. More specifically, it bars state agencies and employees from cooperating with federal and out-of-state investigations regarding the provision of reproductive health care legal in the state; creates a cause of action for persons against whom a judgment was entered in another state based upon that person allegedly providing, receiving, or helping another person to provide reproductive health care services; and prohibits an insurer from taking an adverse action against a health care provider or organization for performing or providing reproductive health care services that are lawful in Delaware.

    Governor Meyer Expands Maternal Healthcare Access

    Governor Meyer released a proposed healthcare plan at the start of his term, illustrating his administration’ prioritization of health care access and protections. Governor Meyer’s plan largely focuses on increasing access to critical health care, promoting equity, and expanding coverage. More specifically, his plan includes increasing funding for the state’s Perinatal Quality Collaborative, improving maternal health, emphasizing Black maternal health, improving access to preconception care, protecting Medicaid coverage, and promoting safe sleep practices to reduce Sudden Infant Death Syndrome (SIDS).

    Challenging Mifepristone Restrictions

    In August 2025, Delaware joined a multi-state coalition in filing a petition to the U.S. Food and Drug Administration to remove medically unnecessary, burdensome restrictions on mifepristone, a safe and effective abortion medication. The petition states that “given mifepristone’s well-established safety record in the United States over the last 25 years, its critical importance for abortion care and miscarriage management in Petitioner States, and the undue burdens the Mifepristone REMS Program places on patient access and the health care delivery system, the Mifepristone REMS Program should be removed in its entirety, or alternatively, FDA should exercise its discretion not to enforce the Mifepristone REMS Program (or elements thereof) in Petitioner States.”

    Governor Meyer signed a critical new law (HB 205) to protect healthcare providers delivering abortion care in the state. This means practitioners in Delaware cannot face legal action for abortion and reproductive services, fertility and IVF treatments, as well as gender-affirming care, which are all protected under Delaware law.

    Governor Matt Meyer announced today that he will represent Delaware as a continuing member of the Reproductive Freedom Alliance (RFA), a nonpartisan coalition of governors committed to protecting and expanding reproductive health care in the wake of the U.S. Supreme Court’s decision to overturn Roe v. Wade.
