    Governor Meyer Signs Reproductive Health-Related Bills Strengthening Protections for Overlooked Populations

    On July 21, 2025, Delaware Governor Matt Meyers signed a bill that amends the state’s shield law to protect all health care services. This bill expands the types of legal orders that the state cannot comply with. These legal orders include arrest warrants and all other legal processes for obtaining testimony or information for investigations pertaining to legally provided health care. He additionally signed a bill that creates policies and procedures within the Department of Corrections for lactating incarcerated people.

    Shield Act 2.0

    In August 2025, Governor Healey signed S.B. 2543) into law, which updates and expands Massachusetts’ shield law. The law prohibits state agencies and law enforcement from cooperating with outside state or federal investigations, limits the collection and sharing of electronic reproductive health information, and allows providers to list their practice’s name on abortion medications, rather than their own name.

    House Bill 205

    In July 2025, Governor Meyer signed House Bill 205 into law, which strengthens the state’s reproductive health shield law. More specifically, it bars state agencies and employees from cooperating with federal and out-of-state investigations regarding the provision of reproductive health care legal in the state; creates a cause of action for persons against whom a judgment was entered in another state based upon that person allegedly providing, receiving, or helping another person to provide reproductive health care services; and prohibits an insurer from taking an adverse action against a health care provider or organization for performing or providing reproductive health care services that are lawful in Delaware.

    House Bill 7287

    In June 2025, Governor Lamont signed House Bill 7287 into law. This appropriation package establishes a “Safe Harbor Account.” The Safe Harbor Account is a separate non-lapsing account to receive funds and disperse grants to health care providers that provide gender affirming and reproductive health care as well as non-profit organizations. Moreover, this law expands shield law protections, protecting providers and allowing patients, providers, and assistants to recover damages when an out of state actor seeks to enforce an out of state judgement.

    LD 538 – “An Act to Amend Maine’s Prescription Drug Labeling Law”

    In May 2025, Governor Mills signed Legislative Document 538 into law, allowing prescribers to use the name of their facility in place of their own name on the label for medication abortion and gender affirming care prescriptions.

    Senate Bill 5632

    In May 2025, Governor Ferguson signed S.B. 5632 into law, which updates the state’s shield law to define “assistance” as that term relates to the provision or receipt of protected health care services that are legal in Washington. In doing so, the bill expands shield law protections that prohibits agents of state or local agencies, commissions, boards, and departments from cooperating with or providing information to other entities for the purpose of advancing out-of-state anti-abortion prosecutions. S.B. 5632 also requires Washington businesses that provide electronic communication services to notify the Attorney General’s Office if the entity receives legal process related to the provision or receipt of protected health care services when the required attestation is missing or incomplete.

    Senate Bill 129

    In April 2025, Governor Polis signed Senate Bill 129, which expands the state’s shield law (SB23-188). SB 129 allows a provider to list the practice’s name on the prescription of abortion medications instead of their name, provides additional protections for out-of-state telehealth providers, and places additional restrictions on subpoena, investigations, and summons against reproductive care providers.

    This critical law greatly expands protections for reproductive care providers, who face increased threats and attacks by anti-abortion states and actors.

    The Massachusetts Department of Public Health’s (DPH) Board of Registration in Nursing approved emergency amendments to regulations that will protect nurses from disqualification from licensure and from Board discipline for providing, or assisting in providing, reproductive health care services in Massachusetts.
